This message confirms that when the User clicks the "Create Account" button with the HONG MOVE Application, the User accepts the main terms of service of HONG MOVE, including the specific terms and conditions governing the use of the Application in Thailand, which the User must read and understand before accepting. If the User does not accept these terms, the User should stop using the Application immediately.

1. Definitions

Unless otherwise specifically provided in the Terms and Conditions specific to each type of service, the following terms shall have the meanings set forth herein:

“Company” Refers to Hong Move Co., Ltd., the developer, owner, and provider of the HONG Driver application for drivers and the HONG MOVE application for passengers. The Company is not directly involved in providing transportation or messenger services. Additionally, the Company does not operate as a transportation or messenger service provider, nor does it own, control, or employ vehicles or individuals acting as drivers or messengers.

"Chat Function" Refers to the communication service within the HONG Driver and HONG MOVE applications that allows drivers and passengers to exchange messages and images in real-time.

“HONG MOVE” means Hongmove Company Limited as part of the application for users or passengers. “HONG MOVE Application” means the application or website developed, owned and provided by

By the company, which users can use to send requests for service from service providers.

“HONG Driver Application” means the application developed, owned and provided by the Company, which allows users to use the passenger transportation service.

“Service” means the HONG MOVE service, whereby each type of service is provided by Passengers who can place an order via the HONG MOVE application.

“Service Provider” means a delivery person acting on behalf of the Driver or Drivers or any service providers to whom the User can place an order via the HONG MOVE Application, as the case may be.

“User Account” means the online account created by the Company for each User in the HONG MOVE Application upon registration, whereby the User may send instructions to use the Service.

“User, Passenger or You” means the user of the HONG MOVE application who sends an order to use the Service.

“HONG Driver Service Specific Terms” means the terms and conditions relating specifically to the HONG Driver Service, which can be read in detail at https://hongmove.com/terms-hong-move-driver/

2. Agreements

2.1 The User confirms that he/she is of legal age or has received parental consent to use the HONG MOVE application and related services.

2.2 Users understand and agree that the HONG MOVE application is only a platform for automatically matching users with service providers to perform according to the specified conditions of each type of service.

2.3 In the event that the User is not satisfied with the automatically matched service provider, the User has the right to cancel the order, depending on the specific terms and conditions of that service.

2.4 The User agrees not to induce, persuade or attempt to induce or persuade to have a business impact on the Company which operates in Thailand or to take any action that may affect the business relationship between the Company and the service provider, whether directly or indirectly, resulting from the User's own use of the HONG MOVE application.

2.5 By using the HONG MOVE application, the user agrees to comply with the following terms and conditions:

2.5.1 The User shall use the Service only for lawful purposes.
2.5.2 The User shall use the Service only for the purposes for which the Application is intended to be used.

2.5.3 The User shall not use the HONG MOVE application and/or the Service for any fraudulent or illegal activities.

2.5.4 The User shall not use the HONG MOVE application and/or the Service for any other purposes unrelated to receiving the specified Service.

2.5.5 The User shall not perform any action that causes damage or disrupts the operation of the HONG MOVE application network and/or the service network.

2.6 The User confirms that he/she has read and fully accepts the terms and conditions specific to each type of service.

2.7 In using the service, the user agrees to comply with the main terms of service in all respects. The user warrants and confirms that the information provided to the company for the purpose of using the service is true, complete, current and correct. If such information is untrue, incomplete, not current or incorrect, the user agrees that the company will not have any duties and responsibilities, whether directly or indirectly, resulting from the use of such incorrect information.

3. Limitation of Warranty Liability

3.1 Since the Company is not involved in any way in the Service, the Company does not guarantee the performance of the Service Provider or any action of the Service Provider, whether intentional or negligent.

3.2 The Company makes no representation, warranty, condition (whether express or implied) or guarantee regarding the reliability, safety, timeliness, quality, suitability or availability of any Service, the HONG MOVE Application and/or the Software. The Company makes no representation, condition or guarantee, whether express or implied, that: (a) the use of the Service and/or the HONG MOVE Application will be satisfactory, of good quality, safe, timely, uninterrupted or free from any defects or capable of working with any device, software, system or data; (b) the Service and/or the HONG MOVE Application, including the quality of any product, service, data or anything you use or receive through the Application;

HONG MOVE will be suitable for the purpose, meet the needs or expectations (c) The information will be accurate or reliable.

3.3 The Company is not responsible for any delayed service, failure to perform duties, or cancellation of services due to the user providing incorrect information, such as the recipient's name, contact details, and/or address, or the user not confirming the information, or the service provider being unable to contact the user.

3.4 The Company does not guarantee and does not warrant that the HONGMOVE Application and/or related software will be free from delays, errors, viruses or harmful software, and does not guarantee that the information, features, functions or any other information presented on or through the HONG MOVE Application or any other media referred to will be accurate, useful or correct. However, the Company will use reasonable efforts to prevent such cases.

4. Payment methods and conditions

4.1 The user must pay in cash according to the terms and conditions immediately upon completion of the service.

4.2 The User must choose to pay the Service Fee and related expenses (if any) in cash directly to the Service Provider. The User agrees to prepare an amount equal to or close to the Service Fee.

4.3 Payment terms and conditions may vary depending on the type of service and are subject to the specific terms and conditions of each type of service.

4.4 If the User refuses to pay the service fee and/or related expenses (if any) that are due and payable under the terms and conditions of each type, the User will not be able to make any further orders in the HONG MOVE application until the outstanding amount has been paid in full.

4.5 The Service Provider reserves the right to contact the User to take necessary actions regarding the Service, including but not limited to collecting outstanding payments arising from the use of the Service.

4.6 The User is not required to pay any special compensation or special rewards to the Service Provider. However, the User has the right to pay such special compensation or special rewards by paying cash directly to the Service Provider who provides the Service to the User, which special compensation is considered voluntary and is not part of the Service Fee.

5. Limitation of Liability

5.1 The Company is the developer, owner and service provider of the HONG MOVE application which performs the following functions:

5.2 The Company shall not be liable to the User or assume any liability in the event of any loss or damage arising from or resulting from the Service, whether jointly or separately, but only to the extent permitted by applicable law. The User acknowledges and agrees that all risks from the User's use of the Service are solely at the User's risk, and the User has no right to claim damages from the Company in any case, except that such loss or damage is caused by the Company's breach of the Main Terms of Service, fraud, or gross negligence of the Company itself.

6. Cancellation

6.1 The user has the right to cancel the order to use the service according to the terms and conditions specific to each type of service, which may incur a cancellation fee as determined by the Company.

7. Compensation for damages

User agrees to defend, indemnify and hold the Company harmless from any and all claims, costs and legal fees arising from the following events: (a) User's breach of the Main Terms of Service; (b) User's fraud, misconduct or gross negligence; (c) User's misuse of the HONG MOVE Application; (d) User's violation of any applicable law or regulation.

8. User account

8.1 The User agrees to use the User's account (email) and password on the HONG MOVE application or any other platform as determined by the Company ("User Account"), which has been verified and confirmed by the HONG MOVE application, for use in applying for the Company's services.

8.2 In using the HONG MOVE application, the Company may send messages/notifications as part of the User's normal business operations in using the HONG MOVE application via the HONG MOVE application.

8.3 Users shall register, maintain and maintain the security and confidentiality of their user accounts, including but not limited to keeping the user's username and password confidential and not sharing personal information about the user's user account with others. The Company shall not be responsible or liable for any loss or damage, whether direct or indirect, arising or may arise from another person's use of the user's user account, regardless of whether the user is aware of such use or not.

8.4 The User agrees not to
(a) Violate the Main Terms of this Service and/or Specific Terms and Conditions and/or any other terms of the Company; (b) Commit any illegal, fraudulent, abusive, deceptive, threatening, intimidating or defamatory behavior; (c) Misuse the discount coupon, such as selling the discount coupon at a price higher/lower than the coupon price or using the discount coupon in excessive amounts; (d) Upload, email, post, transmit or otherwise make available any Content that is illegal, threatening, intimidating, abusive, alarming, distressing, fraudulent, defamatory, vulgar, obscene, defamatory, politically sensitive, privacy-invasive, hateful, racially or ethnically offensive, or Content that the User does not have the right to make available under the law or under contractual relationships or authorization, or Content that is spam, junk email, chain letters, or Content of an inappropriate nature; (c) Take any action or use the account in a manner that is in violation of any law, regulation, order, policy, practice.

8.5 User accounts cannot be transferred to another person.

8.6 The Company reserves the right to temporarily or permanently suspend and/or terminate the user account at any time for the following actions: (a) Violation of the Main Terms of this Service or the Specific Terms and Conditions and/or any other terms of the Company; (b) Illegal, fraudulent, abusive, deceptive, threatening, intimidating or defamatory behavior; (c) Misuse of discount coupons, such as selling discount coupons at prices higher/lower than the discount coupon price or using discount coupons in large quantities; (d) Upload, email, post, transmit or otherwise make available any content that is illegal, threatening, threatening, abusive, alarming, distressing, fraudulent, defamatory, vulgar, obscene, defamatory, politically sensitive, privacy-invasive, hateful, racially or ethnically offensive, or content that the user does not have the right to make available under the law or under contractual relationships or authorization; or content that is spam, junk email, chain letters or inappropriate content. (e) Perform any action or use of an account ID that is in violation of any law, regulation, order, policy, or practice, which may lead to the temporary suspension and/or termination of the user's account by the Company without notice, including but not limited to being restricted from participating in any activities of the Company or being denied new applications for the Company's services, or being prosecuted, whether criminal or civil, and claiming for damages and losses as the Company deems appropriate.

8.7 The User may cancel his/her User account on the HONG MOVE Application by clicking on the Cancel User Account button on the HONG MOVE Application by himself/herself. However,: (a) the User's User account will be suspended immediately. (b) Information on the User account, such as history, location, payment methods, discount coupons, messages, will be deleted from the Company's system within 3 days from the date the User cancels the User account on the HONG MOVE Application. (c) After 30 days from the date the User cancels the User account on the HONG MOVE Application, information on the User account, such as history, location, payment methods, discount coupons, messages, will be permanently deleted from the Company's system. (d) The Company may retain some information after the User's User account has been canceled for the purpose of complaints or any legal proceedings.

10. Review

10.1 Users can express their opinions or share their experiences of using the services provided as ordered on the HONG MOVE application.

10.2 In the event that the user's review or comment contains distorted, incorrect, out-of-date content, or is against the law or is an unfair expression of opinion, the user agrees to accept sole responsibility for any liability that arises, whether civil or criminal, and will solely compensate the Company for any damages caused.

11. History of past service calls

11.1 History of Service Calls: Users can view the history of service calls (service call items, date and time of order, service fee, and payment channel) for the past ninety (90) days from the date of service use on the HONG MOVE application.

11.2 Error Correction and Complaints In the event that the User finds any errors in the service history or has any other claims or needs information about the service, please contact the Help Center on the HONG MOVE application and provide the necessary information for the Company to consider taking action according to the User's request. Any claim regarding an error in the order must be notified to the Company within ninety (90) days from the date of ordering or using the service, otherwise, the User shall be deemed to have waived the right to claim and release the Company from any liability resulting from the error in the order. In this regard, the Company is not obliged to correct any errors, unless otherwise required by law.

12. Discount coupons

12.1 Users may receive discount coupons from the Company's system or by other methods as determined by the Company. The terms and conditions for using discount coupons will be in accordance with the terms and conditions determined by the Company each time.

12.2 If the User uses a discount coupon in conjunction with such service and if such service is canceled for any reason, such discount coupon cannot be used again in any case.

12.3 Discount coupons cannot be transferred to another person or exchanged for cash in any case.

12.4 In the event of improper acquisition of discount coupons, the Company reserves the right to immediately cancel the use of the discount coupons by the User without prior notice, and the Company may take legal action as it deems appropriate.

12.5 The Company may cancel the granting of discount coupons or suspend the user's right to use discount coupons at any time at the Company's sole discretion.

12.6 The User agrees to be responsible for any tax arising from receiving or using the discount coupon by himself/herself, and the Company may deduct such tax at the time or after the order for such product/service.

13. Delivery

13.1 The User may use the HONG Driver Service to transport passengers, provided that the User agrees to comply with the HONG Driver Terms of Service as set out in the Company's Specific Terms on HONG Driver Services.

13.2 If the User does not use the Company's HONG Driver service or if the User agrees to any delivery details other than those specified in the Company's system, the Company reserves the right not to be responsible for any loss or damage resulting from such actions in any case.

14. Accessing networks and devices
14.1 The User is responsible for obtaining the data and/or network access to use the HONG MOVE Application and if the User accesses and uses the HONG MOVE Application on his/her own mobile phone, the User shall be responsible for any related charges from the User's telecommunications service provider.
14.2 The Company does not guarantee that the HONG MOVE application will always work properly on any type of device.

14.3 The HONG MOVE application may not function normally and/or be delayed due to the use of the Internet, the speed of the Internet, and the density of the electronic communication system, including cases where the user's or service provider's equipment malfunctions, is not connected, is outside the signal area, is turned off, or does not work. The Company will not be responsible for any delays, failures in delivery, failures of services, damages, or losses resulting from such problems.

15. Intellectual property

The Company is the owner of the intellectual property rights in the user interface screen, graphics, design, compilation, information, products, software, services or other elements of the HONG MOVE application, source code and/or related software (“Content”). The Company grants a non-exclusive and non-transferable right to use the HONG MOVE application and/or related software for the purpose of sending service orders from partner companies and/or service providers to users, which users may not sell, license, distribute, reproduce, modify, publicly display or publicly display, communicate, broadcast, publish, edit, modify, create derivative works from or use the Content without permission. The Company reserves all rights not expressly granted in the main terms of this Service.

16. User privacy

Users’ privacy is very important to the Company and the Company has developed a Privacy Policy that explains its privacy practices in detail (Users can view the Company’s Privacy Policy via a link on the Company’s Platform and website). Please read this Privacy Policy carefully to understand how the Company collects and uses information related to Users’ accounts and/or use of the Services (“User Information”).

By using the service or providing information via the site, users

(i) The User consents to the Company collecting, using, disclosing and/or processing the User's Content, Personal Data and User Information as described in the Privacy Policy.

(ii) The User warrants that any Personal Data the User provides to the Company is accurate, current, complete and not misleading as of the date the data is provided. The User further acknowledges that it is the User's responsibility to notify the Company of any changes to the User's Personal Data so that the Company can update the User's data.

To be accurate, current, complete and non-misleading as much as possible. In the event that the User fails to notify the Company of any changes to the Personal Data, the Personal Data under the Company's control shall be deemed to remain accurate, current, complete and non-misleading. The User acknowledges and agrees to waive any rights to dispute or take legal action against the Company for any inaccuracy, non-current, incompleteness or misleadingness of the User's Personal Data under the Company's control.

(iii) The User agrees and accepts that the ownership rights in the User's data belong to the Company and the User jointly.

(iv) The User shall not disclose the User's information to any third party, whether in whole or in part, or allow any third party to access or use the User's information without prior written consent from the Company.

17. Privacy of other persons

In the event that the User provides the Company with personal data of another person, the User warrants that the User has informed such person about the Company's services and related data processing as described in the relevant privacy policy before submitting such person's personal data to the Company, and the User warrants that the User has obtained such person's consent for the Company's services and related data processing.

User acknowledges that the Company may disclose personal information of other persons to User during the use of the Company's services. User represents and warrants that User will use such personal information only for the purposes disclosed by the Company to User and not for any other unauthorized purposes.

If any provision of these Master Terms of Service, Specific Terms and Conditions and/or the Privacy Policy (as the case may be) is held to be unenforceable, the remaining provisions of these Master Terms of Service, Specific Terms and Conditions and/or the Privacy Policy (as the case may be) will remain in full force and effect.

22. Applicable Law

22.1 These Terms of Service shall be governed by and construed in accordance with the laws of Thailand.

22.2 The courts of Thailand shall have exclusive jurisdiction to hear and decide any lawsuit, action, proceeding and dispute that may arise out of or in connection with these Terms of Service.
